Abstract

This study aims to determine and analyze, the practice of paylater cash swipe services and the factors that cause paylater cash swipe services in Banjarmasin. This research is field research and the research approach used in this research is a qualitative descriptive approach method. Furthermore, the provider and service user make engineering buying and selling transactions to cash out the paylater balance limit. In paylater transactions associated with qardh transactions, there is an element of riba. Then, the terms of the sale and purchase contract contain fraudulent transactions or tadlis, so the valid conditions of the sale and purchase transaction are not fulfilled and the sale and purchase contract becomes void. The reason for doing paylater cash swipe services by the owner/service provider is because they want to increase their income and for service users because they need money quickly. The profit from the services performed by the owner/service provider is from the fee. This activity on the object of ujrah is prohibited and the contract of ujrah becomes fasid even though it fulfills the pillars and conditionsbut the background of the transaction activity is prohibited by shara' law
